Terms & conditions

1. Who we are

These terms belong to Under Above Music, the company behind DJ and producer Under Above, registered at Horstveld 42, 6093 DH Heythuysen, the Netherlands, listed with the Dutch Chamber of Commerce under number 84281596, VAT number NL003941026B53. You can reach us at info@underabove.nl or +31 6 156 43369. In this text, "the artist" is Under Above and "the client" is the club, festival, company or private person booking a performance.

2. What these terms cover

These terms apply to every request, quote, booking and performance, and to the use of underabove.nl. Different arrangements only apply when they are put in writing, by email or in a booking contract. The client's own purchasing terms do not apply unless the artist has accepted them in writing beforehand.

3. Requests and confirmation

A request by email or WhatsApp is without obligation. A booking only exists once the artist confirms the date, the set time, the venue and the fee in writing. A hold on a date lapses automatically after fourteen days, unless agreed otherwise.

4. Fee and payment

The fee covers preparation and excludes VAT, travel and any accommodation costs, unless expressly agreed otherwise. Invoices are paid within fourteen days of the performance, or earlier where that has been agreed. For bookings by private clients, payment in advance or a deposit may be requested. Late payment carries statutory commercial interest, plus reasonable collection costs.

5. Travel and accommodation

Travel costs are agreed in advance. For a performance more than 150 kilometres from Roermond, or one ending after 01:00, the client arranges accommodation for the artist and one companion, unless agreed otherwise.

6. Technical requirements

The client provides a working, professional sound and light system suited to the room, and the equipment listed in the technical rider. The rider is available on request and is included in the press kit. If the client cannot meet the rider, they say so no later than seven days before the performance so a solution can be found together.

7. Set times and check

The agreed set time and end time are fixed. The artist arrives at least one hour before the start and is given the opportunity for a short check. Moving or extending the set on the day itself is possible only by agreement, and against an additional fee.

8. Cancellation by the client

If the client cancels a confirmed booking:

  • more than 60 days before the performance: 25% of the fee;
  • 60 to 14 days before the performance: 50% of the fee;
  • within 14 days of the performance: 100% of the fee.

Costs already incurred, such as booked travel or accommodation, are charged on top. If a cancelled performance is rescheduled within six months, any amount already paid is set off against the new date.

9. Cancellation by the artist and force majeure

If illness, an accident, a cancelled flight, a government measure or other force majeure prevents the artist from performing, the artist says so immediately and works with the client to find an equivalent replacement or a new date. If neither is possible, any fee already paid is refunded. Further compensation is excluded in that case.

10. At the venue

The client provides a safe place to play: a stable and dry DJ booth, a sound power supply and, for outdoor shows, cover from the weather. The client also arranges access for the artist and one companion, a lockable space for personal belongings and, where needed, security. The artist decides what to play.

11. Promotion, photos and recordings

The client may use the name, logo and press photos of Under Above to announce the performance. The press photos are in the press kit; always credit the photographer. Audio or video recordings of the performance that go beyond atmospheric social media clips are agreed in advance. The artist may film the performance and use that material for their own promotion.

12. Copyright

The rights to the music, recordings, texts, logo and imagery of Under Above stay with the artist and the other rights holders involved. The client is responsible for reporting and paying performing rights to Buma/Stemra or the equivalent organisation for the venue where the performance takes place.

13. Liability

The artist's liability is limited to the fee for the performance in question. The artist is not liable for indirect loss, such as lost revenue or missed income. Damage to the artist's equipment caused during the performance by visitors or venue staff is for the client's account. These limits do not apply in cases of intent or deliberate recklessness.

14. This website

The information on underabove.nl is put together with care, but no rights can be derived from release dates, tracklists or tour dates. Downloads from the press kit may be used for editorial and promotional publications about Under Above, crediting the photographer. Any other use needs permission in advance.

15. Privacy

Details shared by email or WhatsApp are used only to handle the request and the booking, and to keep the books. They are not sold to third parties. Requests for access or deletion can go to info@underabove.nl.

16. Governing law

Dutch law applies to these terms and to every booking. Disputes go to the competent court in the district of Limburg, unless the law compels otherwise. Before it gets that far, we assume a phone call works faster.
