Terms and Conditions

1. Definitions

1.1 Under Above Music trading under the name Under Above Music, Under Above Publishing, Under Above Management and Nonchalance Events established in Roermond under Chamber of Commerce no. 84281596

1.2 Customer: the person with whom Under Above Music has entered into an agreement.

1.3 Parties: Under Above Music and the customer together.

1.4 Consumer: a customer who is also an individual and who acts as a private person.

2. Applicability of general terms and conditions

2.1 These terms and conditions apply to all quotations, offers, work, orders, agreements and deliveries of services or products by or on behalf of Under Above Music.

2.2 Parties can only deviate from these terms and conditions if they have expressly agreed so in writing.

2.3 The parties expressly exclude the applicability of additional and/or deviating general terms and conditions of the customer or of third parties.

3. Offers and quotes

3.1 Offers and quotations from Under Above Music are without obligation, unless explicitly stated otherwise.

3.2 An offer or quotation is valid for a maximum of 2 weeks, unless a different acceptance period is stated in the offer or quotation.

3.3 If the customer does not accept an offer or quotation within the applicable term, the offer or quotation will lapse.

4. Acceptance

4.1 Upon acceptance of a quotation or offer without obligation, Under Above Music reserves the right to withdraw the quotation or offer within 3 days after receipt of the acceptance, without the customer being able to derive any rights from this.

4.2 Verbal acceptance of the customer only binds Under Above Music after the customer has confirmed this in writing (or electronically).

5. Prices

5.1 All prices that Under Above Music uses are in euros, excluding VAT, excluding any other costs such as administration costs, levies and travel, shipping or transport costs, unless explicitly stated otherwise or otherwise agreed.

5.2 All prices that Under Above Music uses for its services, on its website or that are otherwise made known, Under Above Music can change at any time.

6. Performance of the agreement

6.1 Under Above Music performs the agreement to the best of its knowledge and ability and in accordance with the requirements of good workmanship.

6.2  It is the responsibility of the customer that Under Above Music can start the execution of the agreement in time.

6.3  If the customer has not ensured that Under Above Music can start the execution of the agreement in time, the resulting additional costs and/or extra hours will be borne by the customer.

7. Cancellation

7.1 If the customer cancels the agreement within 3 weeks before the execution, 50% of the agreed amount will be charged by Under Above Music.
